Two Co. Tyrone brothers have been fined in court for failing to correctly dispose of waste.

John McDonnell of Frenchman’s Lane, Castlecaulfield, and Peter McDonnell of Reclain Road, Dungannon, were recently fined a total of £9,000 (€10,036) at Dungannon Magistrates’ Court for breaches of waste management legislation.

John McDonnell pleaded guilty to unlawfully depositing, keeping and burning construction and demolition waste on unlicensed lands at Finulagh Road in Castlecaulfield, between September 2015 and May 2016.

Peter McDonnell also pleaded guilty to unlawfully depositing and keeping controlled waste on lands adjacent to 18 Finulagh Road between May 26, 2016, and October 7, 2016.

Officers from the Northern Ireland Environment Agency identified that the waste had been transferred from the aforementioned site run by John McDonnell.

Charges

Both brothers were fined £2,000 (€2,230) each under Article 4 (1)(a), in connection with the deposit, treating, keeping, disposal and the failure to prevent the escape of controlled waste, or knowingly causing or knowingly permitting controlled waste to be treated, kept or disposed of in or on any land except under and in accordance with a waste management licence.

The other charge, Article 4(1)(b) relates to the deposit, treating, keeping and disposal of controlled waste, or knowingly causing or knowingly permitting controlled waste to be treated, kept or disposed of in or on any land except under and in accordance with a waste management licence.

Under this charge, John McDonnell was fined £4,000 (€4,460), while Peter McDonnell was fined £1,000 (€1,115).

It comes just days after JCB (NI) was fined £7,500 (€8,363) after an incident at it’s Larne plant saw 40,000L of diesel end up in the Irish Sea. The incident created a 12-mile long slick along the east coast.
